ALBANY, N.Y. It's known as "Three Men in a Room," the annual closed-door gathering where New York's governor, Assembly speaker and Senate majority leader hash out the state's most important legislation. The arrest on Thursday of Speaker Sheldon Silver on corruption charges is threatening to disturb that balance of power. While Albany has been saddled with a reputation for graft and dysfunction for decades, Silver, Gov. Andrew Cuomo and Republican Majority Leader Dean Skelos joined forces to push through four consecutive on-time balanced budgets and legislation on issues from same-sex marriage to gun control. A weakened Silver, who's retaining the post he's held for 20 years even as he faces calls to resign, may make it more difficult for Cuomo to accomplish his ambitious second-term agenda. An unabashed liberal backed by labor unions, Silver has helped Cuomo, a fellow Democrat, win over a chamber whose members don't always agree with the governor's limits on spending and worker benefits. "For a long-term speaker of the Assembly to even be charged with wrongdoing is a serious blemish that severely compromises his ability to lead that chamber," said Dick Dadey, executive director of the nonprofit Citizens Union, a New York- based government watchdog. Silver, 70, used his position to refer asbestos cases from a doctor to Weitz Luxenberg PC, a personal injury law firm he worked for, and to induce developers to retain another law firm, collecting as much as $6 million in kickbacks, according to a complaint unsealed Thursday in Manhattan federal court. Charged with five counts including conspiracy and fraud, the lawmaker faces as long as 20 years in prison on each count. Manhattan U.S. Attorney Preet Bharara, who brought the case against Silver and has been probing the legislature and the Cuomo administration over its handling of an anti-corruption commission, said more may be coming. "These charges in our view go to the very core of what ails Albany: lack of transparency, lack of accountability, and lack of principle, joined with overabundance of greed, cronyism and self-dealing," Bharara said at a news conference in New York. "As our unfinished fight against public corruption continues, you should stay tuned." Cuomo came to the statehouse four years ago on a vow to clean up Albany, a tacit challenge to Silver, who has controlled the lower chamber since 1994. In July 2013, with lawmakers refusing to approve new ethics measures, including requirements to disclose their outside business relationships, Cuomo created a panel called a Moreland Commission to probe the legislature. According to the indictment, Cuomo brokered a deal to disband the panel in March 2014 in exchange for a timely spending plan and new ethics rules that wouldn't require full disclosure of income, which Silver opposed. "It was business as usual with the three men in the room together," said Assemblyman Charles Barron, a Brooklyn Democrat who stepped outside party lines to call on Silver to step down Thursday after the majority of Assembly Democrats backed him. Next year, he would become the longest serving speaker in New York history. "I am confident that after a full hearing that I will be vindicated of these charges," a subdued Silver told reporters as he walked out of Manhattan Magistrate's Court Thursday, wearing a charcoal pinstripe suit with a maroon tie. He was freed on a $200,000 bond. The U.S. froze $3.8 million of Silver's funds, allegedly connected to the scheme. Cuomo told the New York Daily News editorial board that Silver's arrest reflects poorly on the state, though he wouldn't say if the speaker should step down, according to the newspaper. "Obviously, it's bad for the speaker, but it's also a bad reflection on government and it adds to the negativity," Cuomo said. "I want to see the facts before I have an opinion." Skelos said it's up to the Assembly to decide if Silver's reign should continue. "I was surprised," Skelos told reporters in Albany, when asked about the charges. "But government moves forward." The speaker's arrest "sent a chill throughout the political establishment," said George Arzt, a Manhattan-based Democratic political consultant. After the New York Times reported Silver's pending arrest on its website shortly after midnight Thursday, Arzt said he received calls and emails from clients, including Assembly members, asking what the charges might portend for them and their outside work. As unsettled as the chamber is, there's precedent for a sitting speaker to stay in the post while under indictment. Melvin Miller, who as speaker in 1987 appointed Silver as chairman of the Assembly's codes committee, lost his seat in 1991 after he was convicted of fraud related to a real-estate deal. The verdict was overturned on appeal. Miller said in a telephone interview Thursday that even as he faced criminal charges, "we worked through the session, negotiated the bills." Silver won't have a problem, either, he said. "He's very smart, he's shrewd and he's a good negotiator," Miller said. "He's like the Sphinx. Shelly will sit there and look at you and look at you and look at you, and wear you down." On the Lower East Side, the former enclave for Jewish immigrants and now home to trendy restaurants, Silver's photo still hangs on the wall of the famous Katz's Delicatessen on Houston Street. The speaker has been a customer for years, and news of his arrest was met with shrugs. "Whatever the outcome, it doesn't really change anything for the Lower East Side," co-owner Jake Dell said.
