She also filed a criminal assault complaint with the Dover Police Department on Nov. 5 in which she alleges Busch grabbed her face and smashed her head into a motor coach wall three times. Detectives are still investigating the complaint and no criminal charges have been filed as of Tuesday. The attorneys representing Busch and Driscoll failed to come to an agreement during a mediation session Tuesday morning, which prompted a formal court hearing. Family Court Commissioner David Jones began the proceedings by stating it was up to Driscoll to prove she needed a formal court order against Busch. Busch s attorney, Rusty Hardin of Texas, began his opening remarks by calling Driscoll disingenuous, calculating and mercenary. This is a story that s unbelievable, told by a storyteller that s incredible, said Hardin, who later insinuated Driscoll had gone into the motor coach as an uninvited trespasser to confront Busch over the couple s nasty breakup the week before. Hardin argued that a protection order is not necessary, because the two no longer live together and have homes in different states. During her testimony, Driscoll recalled the events that led leading up to the alleged assault. She said she and Busch had been together for four years, during which time they lived in each other s homes and communicated almost every day, either by phone or by text. Driscoll also spoke of Busch s close relationship with her 9-year-old son, including how he renovated the motor coach to give the boy his own sleeping space. She also claimed to have attended every race in which Busch took part, both as his girlfriend and as president of the Armed Forces Foundation, a veterans-advocacy group with close ties to NASCAR. Page 2 of 2 - But the relationship was not always a smooth one, Driscoll said. In halting, sometimes tearful testimony, she said Busch sometimes would act irrationally, particularly near the end of a racing season if he were not doing well in NASCAR standings. The week before the incident, Driscoll claimed, Busch became infuriated while the couple was driving to Boston from a New Hampshire race. She said she left him at the airport after he flew into a rage and ripped the rearview mirror off the rental car windshield. Even after that incident, Driscoll said she took her son with her to Dover Downs after receiving a text from Busch who said he was lying on the floor of his motor home and crying. She testified that she and Busch talked inside the motor coach for about 10 minutes, as he insulted various members of his racing team, accused her of spying on him and claimed he would kill himself if he had a gun. During this tirade, he suddenly grabbed her face in one hand and squeezed her throat with the other, slamming her head into a wall several times, Driscoll said. Afterward, Driscoll told the court, she gathered her son, who was in another room, and went to a friend s motor home, where she applied a bag of frozen Brussels sprouts to her head to diminish the swelling. Later, she took photographs of her neck and head, showing, she said, where she had been choked. During Hardin s cross-examination, Driscoll acknowledged that she did not call police immediately after the alleged incident. She said she did not file her complaint right away out of fear for how the negative publicity would adversely affect an ongoing, bitter custody dispute between her and her ex-husband.

Mercifully, a difficult, and somewhat odd week of high school basketball came to a close for the Stuttgart Ricebird boys Thursday night. The Birds entered the week at 2-1 overall, and closed the week 2-4 following three losses in four days. Stuttgart participated in the Farmers and Merchants Bank DeWitt Invitational last week, and drew the Clarendon Lions in the first round. As previously written, Stuttgart dropped that game 61-28. The next night, through the oddity that is 4A basketball scheduling, Stuttgart jumped back into conference play by hosting the Riverview Raiders. Stuttgart lost a 57-45 decision, moving its overall mark to 2-3 and 1-1 in conference play. Thursday night, Stuttgart suited up once again to participate in the DeWitt Invitational. This time, Stuttgart would draw Drew Central, which had lost to Riverview the previous Monday night. If one were keeping score, Stuttgart, had they won Monday night, would have played Riverview both Tuesday night in conference play, and Thursday night, out of conference play ... interesting scheduling to say the least. The Birds lost a heartbreaker to Drew Central by the final of 44-42. Stuttgart held a seven point lead, 42-35, with just four minutes remaining in the game. However, Stuttgart would go the game s final four minutes without scoring, allowing Drew Central to take the lead with 18 seconds remaining. A superb defensive effort would go in vain as Stuttgart committed four turnovers in a row to allow the Pirates to come from behind and win. Drew Central employed a diamond and one defense for most of the game in order to keep senior Dewayne Minter from impacting the game drastically. Even without Minter s typical offensive night, the Birds combination of defense and effort should have been enough for the win. Up next for Stuttgart is a trip to Clarendon for a rematch with the Lions, exactly one week after being humbled by 33 points in the oddly paired DeWitt Invitational Tournament. The Lady Ricebirds faried a bit better than their male counterparts last week. Stuttgart played four games in the week, two against Riverview, one inside 2-4A conference play, and one each against Forrest City and DeWitt. The Lady Birds finished the week 2-2 to move their season s record to 4-3 overall and 0-2 in conference play. After dispatching Forrest City Monday night in the DeWitt Invitational, the Lady Birds were upended by Riverview 67-27 Tuesday night in conference play. Stuttgart, by way of DeWitt placing two conference teams on the same side of a mid-season tournament bracket, had the opportunity to face Riverview again Thursday night, but the outcome was no different. The Lady Birds then moved on to play the tournament's host, DeWitt, in the third-place game, and came away with a 38-22 win. The win was the Lady Bird s second of the season over the Dragonettes and secured a 3rd third-place finish for Stuttgart.
