That portion of their income between $35,000 and $75,000 will be taxed at the rate of 6% rather than the 7% rate previously applicable. For 2015, these taxpayers will pay tax at the tax rates in effect in 2014. In 2016, incomes in excess of $75,000 for that portion in excess of $35,100 will be taxed at 6.9 percent, with the remainder taxed at rates in effect in 2014, according to DFA. The agency said the plan also creates a bracket adjustment between $75,000 and $80,000 to offset the bracket creep in that range. Also, this bill repeals capital gains provisions enacted by Act 1488 of 2013, DFA said. Those provisions increased the capital gains exclusion from 30 percent to 50 percent effective tax years 2015 and after and provided an income tax exemption for that portion of capital gain received by an individual taxpayer in excess of $10M in tax year 2014 or after. Both provisions will be repealed effective January 1, 2015 under this bill. DFA said the greatest impact in the plan comes from the change in the capital gains exclusion.At this juncture, nobody appears to be arguing the point that Hutchinson's tinkering with the bracket rate math on one hand generates significant cuts in tax revenue, but actually raises taxes on capital gains with the repeal of Act 1488.
