It's not that Southwest Arkansas legislators want to oppose a so-called middle class tax cut; but, the prospect of passing out a $100 million tax cut package before seeing the nuts and bolts of Gov. Asa Hutchinson's accompanying budget is leaving them jittery on both sides of the aisle.Asked last week for assessments of Hutchinson's tax cut plan, most Southwest Arkansas legislators waited until this week to respond. Why? Normally, we wait until the end of the session to run tax cuts, veteran Senator Larry Teague, D-Nashville, replied. This accomplishes two things: It gives us the discipline to not vote for any tax legislation until we understand the financial position we are in, and we usually wind up with a deal among ourselves to an agreed package and don't pass any other legislation. Consequently, Hutchinson's plan introduced almost as soon as the session began has legislators such as State Rep. Brent Talley, D-McCaskill, wondering whether the Governor is putting the cart before the horse. I support a tax cut for the middle, working class; but, I, like many of my colleagues, am still trying to get confirmed answers to how to pay for it and where the cuts will be made in the state budget, Talley said. I do not like the idea that we must pass the tax cut before we see a budget from the Governor's Office and before we fund key government agencies and programs. The Senate passed Hutchinson's tax package out on first vote Tuesday with both Teague and Senator Jimmy Hickey, R-Texarkana, voting for Senate Bill 6 which encompasses it. Teague had said he would vote for the tax cut, but he remains wary. I have every intention of voting for the tax cut, he said in an e-mail to the Hope Star. However, we don't yet have Governor Hutchinson's budget and I am not convinced it is a good idea to vote for the tax cut until we have his spending recommendations and his revenue projections. Hickey simply demurred in responding at length. I sit on the Senate Tax and Revenue Committee which will vote on this, he said. We have been in discussions with the Governor and he will be providing more information in the next few days. For tax year 2016 and after, taxpayers having taxable income between $21,000 and $75,000 will pay tax on that portion of their income between $21,000 and $35,099 at the rate of 5% rather than the 6% rate in effect for 2014, the LIS notes. That portion of their income between $35,000 and $75,000 will be taxed at the rate of 6% rather than the 7% rate previously applicable. For 2015, these taxpayers will pay tax at the tax rates in effect in 2014. In 2016, incomes in excess of $75,000 for that portion in excess of $35,100 will be taxed at 6.9 percent, with the remainder taxed at rates in effect in 2014, according to DFA. The agency said the plan also creates a bracket adjustment between $75,000 and $80,000 to offset the bracket creep in that range. Also, this bill repeals capital gains provisions enacted by Act 1488 of 2013, DFA said. Those provisions increased the capital gains exclusion from 30 percent to 50 percent effective tax years 2015 and after and provided an income tax exemption for that portion of capital gain received by an individual taxpayer in excess of $10M in tax year 2014 or after. Both provisions will be repealed effective January 1, 2015 under this bill. DFA said the greatest impact in the plan comes from the change in the capital gains exclusion.At this juncture, nobody appears to be arguing the point that Hutchinson's tinkering with the bracket rate math on one hand generates significant cuts in tax revenue, but actually raises taxes on capital gains with the repeal of Act 1488.
